Injury Waiver

“Participant” means the person agreeing to this waiver, being a participant in a recreational skateboarding event organised or conducted by SWA or their legal guardian; and

“SWA” means GMTA Skateboards Pty Ltd (ABN 17 121 820 148) trading as ‘Skateboarding WA’, and includes any of its related bodies corporate and all of its officers, directors, members, employees or agents and those of any of its related bodies corporate, funding partners or event sponsors.

**This waiver must be read by any Participant, and where a Participant is under the age of 12 years, by that Participant’s parent or legal guardian**

WAIVER FOR PARTICIPATING IN SKATEBOARDING WA ACTIVITIES

The Participant acknowledges and agrees that the activity organised or conducted by SWA is in the nature of a dangerous recreational activity and as such, has inherent dangers and risks, including risk of serious injury or death to the Participant.

Use of helmets and other protective gear reduces the risk of serious injury being suffered by the Participant, and is strongly recommended when participating or otherwise engaging in skateboarding activities and SWA events. Use of helmets is mandatory for any Participant under the age of 13 years.

The Participant further acknowledges and agrees that due to the nature of the activity, SWA cannot be held responsible for any injury or harm suffered by the Participant not attributable to the reckless act or omission of SWA, and the Participant by selecting the checkbox below, to the full extent permitted by law, waives all of his, her or their legal rights of action against and fully releases SWA from any and all loss, damages, injury or death howsoever arising out of or in relation to the participation by the Participant in the activities conducted or organised by SWA including without limitation, liability for any negligent or tortious act or omission, breach of duty, breach of contract or breach of statutory duty on the part of SWA.

The Participant further acknowledges and agrees that he or she has undertaken the activity freely, voluntarily and absolutely at his or her own risk and with a full appreciation of the nature and extent of all risks involved in the activity.

By selecting the Injury Waiver checkbox on the online registration form, the Participant and their parent or legal guardian (if applicable) are hereby acknowledging that they have read and understand this waiver of the Participant’s legal rights and accept the risk inherent in participating in skateboarding activities. Further, the Participant does hereby authorise SWA to use or share any footage or images taken by SWA that depict the Participant at SWA’s discretion for promotional, marketing or reporting purposes, ownership of which remains with SWA at all times.
